Public Offer (User Agreement)

This document is a public offer (the "Offer"). It sets out the terms on which ENIGMA DIGITAL LLC (the "Operator") provides access to the Encore software service (the "Service") to any individual who accepts it (the "User").
By subscribing to, paying for, or using the Service, the User fully and unconditionally accepts this Offer. If the User does not agree with any of its terms, the User must not use the Service.

2. Subject of the Offer
2.1. The Operator provides the User with paid access to the Encore software service — an information tool that:
- monitors the availability of tickets to concerts, tours and events from public ticketing sources;
- sends notifications and alerts when tickets become available or a queue opens;
- provides event information and access to the member community.
2.2. The subscription fee is payment for access to the software and its functionality only. It is not payment for tickets and does not include the cost of any tickets.
2.3. The Service does not sell tickets, does not purchase tickets on the User's behalf, and does not resell or trade tickets. All ticket purchases are made by the User independently, in the User's own name, directly on the websites of authorized ticket sellers.
3. Account and access
3.1. Access to the Service is granted to a specific User and is non-transferable. Sharing the license key, or transferring or granting third parties access to the User's account, is prohibited.
3.2. One account represents one individual.
3.3. The Service is informational: it does not purchase, hold or sell tickets. The User purchases tickets independently, from official sellers, and is solely responsible for complying with applicable law and with the terms of ticket sellers and event organizers.
4. Price and payment
4.1. The current price of the subscription is shown to the User at checkout before payment.
4.2. The subscription is purchased for a selected period (for example, one month or a longer term chosen by the User). The subscription does not renew automatically. To continue using the Service after the paid period ends, the User makes a new payment for the next period.
4.3. For the purposes of this Offer prices are denominated in US dollars. Payment is accepted by the methods shown to the User at checkout. The Operator does not store the User's full payment credentials.
4.4. The Operator issues the User an invoice for each payment, containing the date, amount, payment method and the subscription period paid for, and grants access to the Service upon confirmation of payment.
4.5. The price of access to the Service consists of a one-time platform access fee and a subscription fee for the selected period. The one-time platform access fee is paid once, is not part of the subscription fee and is not charged again on renewal, or if access is disabled and later restored.
4.6. Payment is deemed made when the full amount is confirmed as received by the Operator or by its payment provider. Any fees charged by the User's bank or payment provider are borne by the User. Payments made to details other than those provided by the Operator are not credited.
4.7. The Service is deemed rendered for the paid period from the moment access is granted — the license key is issued or reactivated.
4.8. If the subscription is not renewed by the end of the paid period, the license key remains active for one month after that date, so that the User can renew. This period does not extend the paid period, is not a continuation of the Service and does not create a right to a refund. If no renewal payment is made within that month, access is disabled.
4.9. Any refund is made to the same payment method used for the original payment, in the amount denominated in US dollars. Fees charged by the payment provider for the refund transfer are deducted from the amount refunded.
5. Renewal and refunds
5.1. Because the subscription does not renew automatically, the User is never charged again without their own action. If the User does not make a new payment, access ends when the paid period is over, subject to clause 4.8.
5.2. Refund terms are set out in the Refund & Dispute Policy, which forms an integral part of this Offer.
6. Limitation of liability
6.1. The Service is an informational tool. The Operator does not guarantee the availability of any tickets, their price, or that the User will successfully purchase any ticket.
6.2. The Operator is not responsible for the content, operation, prices, policies or actions of third-party ticketing platforms, venues, artists or event organizers, and is not affiliated with them.
6.3. The Operator is not liable for the User's decisions or for any losses arising from the User's purchase or non-purchase of tickets.
6.4. The Service is provided "as is". The Operator is not liable for temporary interruptions caused by maintenance, third-party providers, or circumstances beyond its reasonable control.
7. User obligations
- Provide accurate information when subscribing.
- Use the Service in compliance with this Offer and applicable law.
- Not interfere with the operation of the Service or attempt unauthorized access.
8. Personal data
The Operator processes the User's personal data in accordance with the Privacy Policy and applicable personal data protection legislation. By accepting this Offer, the User confirms acceptance of the Privacy Policy.
9. Amendments
9.1. The Operator may amend this Offer. The current version is always published on the website.
9.2. Continued use of the Service after changes are published constitutes acceptance of the amended terms.
10. Governing law
This Offer is governed by the law of the Republic of Armenia. Disputes that cannot be resolved through negotiation are subject to resolution in accordance with the legislation of the Republic of Armenia.
